EPA Region 10 Stormwater Requirements

On June 30, EPA issued a final 2008 Construction General Permit (CGP) that covers discharges of stormwater from certain construction sites.  Because EPA is in the process of developing a national regulation (called an Effluent Limitations Guideline) for the construction and development industry, this permit contains substantially the same terms and conditions as the 2003 CGP and has been issued for a two-year time period.  The new permit applies only to “new” construction sites (e.g. those that have started construction on or after June 30, 2008 or those that started previously, but did not obtain permit coverage under the 2003 CGP).  For more information on this new permit, please visit  www.epa.gov/npdes/stormwater/cgp

EPA's 2008 General Construction Permit (CGP) section 3.1 requires inspections to be performed by a "qualified person".  ECO 3 has an EPA specific Erosion and Sediment Control training courses to help meet EPA's CGP requirements in Alaska and Idaho

Washington

Synopsys: If you are doing a federal project or a project on federal land, military base or Indian reservation you need to apply directly to the  EPA's 2008 General Construction Permit (CGP)  .  Application can be made using EPA e-noi (electronic notice of intent stormwater application)  Section 9.4 & 9.5 outline the overlay of the oversight between EPA & Washington State Department of Ecology.

Basic Requirement:  EPA Permit & oversight on the project, follow Washington State DOE requirements for inspection and Stormwater Pollution Prevention Planning (SWPPP). No DOE stormwater monitoring or reporting is required, but is strongly recommended.  On military bases, the Army Corp of Engineers may already have a permit.

Oregon

Synopsys: If you are doing a federal project or a project on federal land, military base or Indian reservation you need to apply directly to the  EPA's 2008 General Construction Permit (CGP)  .  Application can be made using EPA e-noi (electronic notice of intent stormwater application)  Section 9.3  outlines the overlay of the oversight between EPA & Oregon Department of Enviornmental Quality (DEQ) on Indian lands.

Basic Requirement:  EPA Permit & oversight on the project, follow Oregon DEQ requirements for inspection and Stormwater Pollution Prevention Planning (SWPPP). On military bases, the Army Corp of Engineers may already have a permit.

Alaska

Synopsys: If you are doing a project clearing more than one (1) acre you must apply directly to the  EPA's 2008 General Construction Permit (CGP)   Application can be made using EPA e-noi (electronic notice of intent stormwater application) Section 9.1  outline the overlay of the oversight between EPA & Alaska Department of Environmental Conservation (DEC) and the City of Anchorage

Basic Requirement:  EPA has permit & oversight on the project, DEC & City of Anchorage have additional requirements for inspection and Stormwater Pollution Prevention Planning (SWPPP).

Idaho
